These general conditions of sale (hereinafter, "general conditions") apply to all sales of products (hereinafter, "products" or "product") purchased via the website www.elettrocomponenti.com (hereinafter, "website").

The use of the e-commerce services described in these General Conditions is reserved exclusively for USERS (hereinafter, "customers" or the "customer"), understood as legal persons acting in their own commercial, business or professional activities.

The available contract languages are Italian and English.

Customers are bound to carefully read the general conditions made available prior to sending any purchase orders.

Contracts concluded with ECO ELETTROCOMPONENTI SRL via the website are governed by Italian law and, in particular, by the Italian Legislative Degree no. 70 of 9 April 2003 (hereinafter, the "E- commerce Decree"). Italian Legislative Decree no. 206 of 6 September 2005 (the "Consumer Code") does not apply.

3. PRODUCT INFORMATION

Via its website, ECO ELETTROCOMPONENTI SRL sells components for lighting attractions, token-operated machines and other apparatus with similar features. The conditions described below govern the sale of the products on the website.

By ordering the goods, customers accept the sales conditions laid down herein.

Orders sent by customers to the vendor are deemed to be a proposal for purchase, and shall be binding for ELETTROCOMPONENTI SRL only after notification to the customer of order acceptance. The vendor will subsequently notify the estimated delivery times.

ECO ELETTROCOMPONENTI SRL undertakes to ensure that the information contained in the website is accurate and updated. No guarantees can however be given in this sense. The customer acknowledges and accepts that the products may not all conform to the indications, specifications and photographs published on the website.

4. PRODUCT ORDERS

Customers select the products from the "cart" menu. This operation must be repeated for each required product, specifying the quantity of each product.

Having selected the required products, the customer should click on “confirm purchase”.

The customer must then provide the information required for invoicing and shipping.

The sales contract between the vendor and the customer is deemed to be concluded when the customer receives the written confirmation of shipment at the e/mail address indicated in the purchase order.

The essential characteristics and prices of the products are given in the offer for each product.

ECO ELETTROCOMPONENTI SRL reserves the right to decide whether to accept each order or not. ECO ELETTROCOMPONENTI SRL will notify the Customer in the event of the impossibility to accept any order received within 48 hours from the working day following the day on which the customer sent the order to ECO ELETTROCOMPONENTI SRL and shall refund any amounts paid by the customer for the supplies.

5. CONFIRMATION OF ORDER RECEIPT

Following acceptance of the contract, the customer will receive by e-mail, the confirmation of the purchase order sent by him.

6. INVALIDITY OF THE ORDER

Contracts shall not be deemed to be concluded between ECO ELETTROCOMPONENTI SRL and the customer if the vendor has a valid reason to believe that the customer has not acted according to an effective and genuine interest in purchasing the ordered products, or has improperly exercised the right of withdrawal. In this case, orders sent by customers shall be considered invalid. ECO ELETTROCOMPONENTI SRL shall notify customers by e-mail in the event of the non-conclusion of the contract, and shall proceed to annul all charges and/or expenditure for his account.

7. PRICES

All prices are shown excluding VAT. Depending on the country of destination (Italy, EU, non-EU countries) of the goods, the ownership of an intra-Community VAT code, the application of VAT shall depend on the national laws in force.

8. PAYMENT TERMS

ECO ELETTROCOMPONENTI SRL accepts payments effected in various ways, depending on the destination of the goods and the amount of the goods purchased. For large orders and orders for bespoke materials, products will be shipped only after the receipt of an advance payment and/or the balance of the due amounts.

Accepted payment terms:

CREDIT CARD: available in all countries served;

ADVANCE BANK TRANSFER: available for all countries, required for bespoke orders and all orders above € 3,500;

CASH ON DELIVERY: available in all EU countries, minimum charge €15.00 or 1% of the amount owed. For amounts less than € 3,500;

9. TRANSPORT AND DELIVERY

The delivery time may vary according to the destination of the products, chosen service and availability of the selected products.

If a particular product selected by the customer is not available at the time of order, the vendor has no obligation to supply the product in question, but shall notify the customer promptly of such circumstance. If only a part of the products indicated in the order are available, ECO ELETTROCOMPONENTI SRL will contact the customers to ask whether they intend to cancel the order or if they prefer to receive only the products available; in this case, the customers will be charged only the amount for the goods received.

In any case, the vendor will notify the delivery time, and shall not respond to any claims over delays in delivery. ECO ELETTROCOMPONENTI SRL shall not be liable for delays caused by incorrect notification of addresses or other information necessary for product delivery.

For all orders made via the website, ECO ELETTROCOMPONENTI SRL issues an invoice for the goods shipped, sent by e-mail or by post to the person placing the order, pursuant to Italian Presidential Decree 445/2000 and Legislative Decree 52/2004. Invoices will be issued according to the information provided by the customer at the time of order. No variations to invoices are possible after issue.

Delivery costs will be charged to the Customer and are clearly indicated on the website. The amount depends on the total amount of each order, the weight and volume of the goods.

The goods may be delivered by express courier or other services, depending on the type of order.

10. OBLIGATIONS OF THE CUSTOMER

The customer undertakes not to use any of the following conduct in his use of the Website:

- false personal details;

- transmission of any material, the promotion of links with obscene, vulgar, fraudulent, defamatory, libellous, threatening, reserved, illegal or otherwise reprehensible contents;

- threatening, insidious or embarrassing behaviour or which may cause difficulties or distress to other participants, users, physical or legal persons;

- attempt to transmit any technically hazardous materials, including but not limited to , viruses, “trojan horses” logic bombs, worms, hazardous components or other instruments which could damage or disrupt the website or the computer system;
- promotion of chain letters or pyramid schemes transmitting correspondence or advertising materials, sending or transmission of any type of unauthorised promotional literature or any form of unwanted soliciting;
- breach of the rights of personal data protection or any other exclusive personal rights of physical or legal persons;
- conduct of any kind that is in breach of the laws in force.

Customers are liable for the contents of any contributions or messages sent to the website; they shall send only the personal data that is strictly functional to the purposes of the correspondence, on condition that such purposes are permissible pursuant to these general conditions and the provisions of the Website; they shall not send any sensitive data concerning themselves or third parties. Any sensitive data received via the website will be immediately and permanently deleted by ECO ELETTROCOMPONENTI SRL and shall not be processed in any way.

Customers shall not send confidential information concerning third parties to the website.

11. PRODUCT WARRANTY

Products are sold by ECO ELETTROCOMPONENTI SRL to professional persons, therefore the vendor undertakes to guarantee that the sold goods are free of defects that may make them unsuitable for use, for a period of one year from the date of shipment. Customers wishing to avail themselves of the warranty shall conserve the invoice, sending the products to ECO ELETTROCOMPONENTI S.r.l for analysis in order to determine the type of defect and assess whether to proceed with a refund, replacement or price reduction. Replacement products will be sent only following the examination of all the faulty items.

For any matters not explicitly governed herein, the provisions of the Italian Civil Code concerning the obligations of the manufacturer or the vendor shall apply.

12. RETURNS

All returns, beyond the terms laid down for the right of withdrawal, must be explicitly authorised in writing by ECO ELETTROCOMPONENTI SRL. Only having received the materials will it be possible to perform an assessment of the value of the goods and any credits for future supplies. Returns will not be authorised beyond two months after the date of sale.

13. RIGHT OF WITHDRAWAL

The right of withdrawal may be exercised with no penalties in terms of costs borne for the product, within 10 days of receipt of the goods by the customer.

The products shall be returned in the same conditions in which they were received, in a perfect state of conservation, complete with all parts, in their original packaging and with all enclosed manuals, and shall not have been used, consumed or damaged.

The right of withdrawal must be notified within 10 days of delivery, by contacting the vendor by phone (at +39-0522.513003), by fax at +39-0522-511082, or by e-mail to info@ elettrocomponenti.com.
The costs of any goods return shall be borne by the customer. The goods shall be sent to: ECO ELETTROCOMPONENTI SRL,Via Melegari 12, 42124 Reggio Emilia.

The transport risks of for product returns remain fully with the purchaser, until the moment of delivery to the above address.

If the returned products are damaged or consumed, their effective value will be assessed and the vendor will have the right to compensate such damages with the payment already made by the customer for the products.

Customers having ordered bespoke goods with specific characteristics shall not have the right to withdrawal, as such goods are not easily resalable.

14. ERRORS

The product information provided on website is updated constantly.
It is not however possible to ensure the complete absence of errors.

ECO ELETTROCOMPONENTI SRL reserves the right to correct any errors, imprecisions or omissions even after an order has been sent, and equally to change or update the prices and information at any time without prior notice.

15. GOVERNING LAW AND JURISDICTION

These general conditions are governed by Italian Law.

Any disputes arising over the interpretation, validity and/or execution of these general conditions shall be referred exclusively to the Courts of Reggio Emilia.
